Well, I got caught last week when I bid on an old Varney B & O switcher, I waited until 2 days before the end before throwing my first bid in in the morning, it wasn't until later that same day that the Seller updated his ad with a comment that the metal shell was showing cracks. And I did not go back and check for comments before the end of the auction, either. He commented 2 days before the auction ended, so there was plenty of time to make a decision on my part, IF I had made myself aware of it. So I got the engine this week, and the zinc pest is very apparently, this will never be a usable engine, will have to be a siding queen, and eventually it will crumble apart I"m sure. It's unpowered, too, so I basically have a nice box and some plastic trucks to show for my stupidity of not rechecking the Comments section before the bidding ended, or I would probably have requested that my bid be allowed to be retracted. Oh well, I have no one to blame but myself, I gave the Seller his 5-star rating, but kicking myself now for not checking back on the entire ad before the end of the auction. Just a heads-up for you folks so you think to do that before an auction ends. The pictures weren't really close up, I couldn't tell, but apparently someone else could, and did contact the seller about it. Oh well. Occasionally you get a dud, and this is one of mine. Wonder if I can fill the interior with epoxy to try to hold it together longer?

You can still challenge it on eBays buyer protection, espacally if changed AFTER you placed your bid. I have used the buyer protection many times and won. That is why when I sell stuff on ebay and the customer is not happy It is easier to refund the money. That is why when a seller puts "I'm not sure it this works" or "No refunds" I still challenge it under buyer protection if I am not happy.

Well, that's the issue, I placed my bid in the morning, I think, I'd have to go back and recheck his new comment and when he placed it. Either way, I should have looked for new comments. I didn't , so I consider it my fault, not the sellers, as he DID post the problem 2 days before the auction ended, not at the last minute, and I only checked my bid, not the entire ad, minutes before it was over. I had time to do so, and just didn't. So, my bad in my opinion. I'm out $18 and shipping, but I can still use it for now, even if it will never run the rails the way I had intended it to. I like to be fair, and if I had the time to recheck the ad, and I did, I can't blame the seller for that. Only my eagerness to buy it was to blame. A siding queen it will be.

When buying powered Tyco I alway buy expecting the piece not to run. This keeps me from being disappointed when I get it. I never contest a purchase on ebay but have not had reason to after 13 years of mostly buying with little selling. eBay has been my source of recollecting my train hobby.

The only way he can change the ad after a bid is to add to the description. He should have emailed you to advise of the change. I think you'd have been within your recourse to not pay because of the change and do a mutual cancellation.

I got caught in a similar way, but what I got was exactly as described. I ended up with a G scale 4-6-0 when I thought I was bidding on an 0n30 4-6-0, and ended up in another auction with an N scale old time coach instead of the HO one I thought I was getting. Both times , my fault for not reading carefully, but the seller held up his end of the deal, so I gave him a five star rating for the service he provided. the items were in excellent shape, if not what I thought I was getting

I'm kind of surprised ebay doesn't automatically notify bidders when an auction they're bidding on gets edited in any way. It seems to me like sellers shouldn't even be able to edit an auction once it's had bids.

Personally I've never had much trouble with ebay. My last auction was kind of a let down though...two Tyco slotcars. Both were missing parts as pictured and described, and neither was advertised as running. Unfortunately, the seller failed to mention one of the cars was missing the entire motor. -___- I didn't catch on until I had the car in my hand and popped the body off. The seller had 100% feedback and seemed like he'd made an honest attempt at describing the cars, so I gave him the benefit of the doubt and let it slide. For $20 I still got a good amount of parts so I just skipped leaving feedback and/or causing a scene.

No, the Comments section allows comments from both Buyers( questions ) and responses. That's different than changing the actual description of the item being sold. And I assume the Seller is allowed to make additional comments himself. So, that being said, I just felt it wasn't the Seller's fault, as he did allow enough time for someone to retract if they felt justified. I just never reread the listing, so I don't hold the Seller at fault on this one. Would be NICE if Ebay notified a buyer of a Seller comment, but I'm not gonna lose sleep over one bad purchase. I can still use the item, but it's fragility will prevent any operational usage now.

I'm with Cheeze, I have gotten items that I felt the seller was getting over on me, but after talking with them I felt it was an honest mistake.

I got a surprise last night when I opened my Ebay Inbox. A seller had opened a case against me for non-payment of an item he said I had won on Ebay earlier this month and had not paid for. After unsuccessfully trying to contact Ebay, I emailed the seller directly. I explained to him that if I had seen the item listed, I certainly would have bid on it, because it was a desireable item that I would like to have. I also told him that, although the time limit for relisting the item had passed, I would be glad to resolve the issue by sending payment for the item. He was agreeable, so that's what we did. Case resolved. I'm supposed to get it later this week, and when I do, I'll probably enter it as a Car of the Week. I'm really glad to get it, although I'm not sure if I'll get to use it as intended

Bob, I'm confused... had you forgotten to pay for something you won, or was the seller mistaken? If he was, why did he think you had bid?

In the past I've received phishing emails claiming to be form eBay demanding payment for a car or some such I had supposedly won. The emails looked quite official, too.

I don't know why hw thought I had bid on it, but he was willing to chalk it up to a mistake if I didn't want it, which I did, because I would have bid on it had I seen it. It was certainly worth the money.
